Tenancy and residential property law

YOUR CHALLENGES

Legal issues relating to property are often complex and involve significant financial risks. In tenancy law, matters such as defects in the property, notices of termination, rent increases or service charge statements regularly lead to disputes between tenants and landlords. Disputes also arise in the context of the law governing owners’ associations, for example regarding service charges, maintenance work, structural alterations or resolutions passed at owners’ meetings.

At the same time, legislation and case law are constantly evolving. This makes it increasingly difficult for owners, investors, property managers and companies in the property sector to reliably assess legal risks and make economically sound decisions. Proactive legal support helps to prevent conflicts at an early stage and safeguard economic interests in the long term.

OUR SOLUTIONS

We provide comprehensive advice and representation to tenants, landlords, flat owners, property management companies, as well as national and international companies in the property sector, institutional investors and public bodies on all matters relating to tenancy and flat ownership law. Our focus is on practical and commercially sound solutions.

Commercial tenancy law
A key area of our practice is commercial tenancy law. Here, we support our clients throughout the entire life cycle of let properties: from drafting and negotiating tenancy agreements, through ongoing legal support, to the termination of tenancies and the handover of let premises. In particular, we draft, review and optimise complex commercial tenancy and lease agreements containing specific usage provisions for retail, office or logistics properties, and assist with the enforcement or defence of claims in both court and out-of-court proceedings, for example in cases of defects in the property or disruptions to business operations.

Residential tenancy law
Our advice on residential tenancy law is aimed in particular at institutional investors, larger property owners and professional landlords. Here, we provide comprehensive advice on all aspects of contract management – such as rent increases, service charge statements, modernisation measures or tenancy disputes. The aim is to manage extensive housing portfolios efficiently and in compliance with the law, whilst at the same time safeguarding commercial flexibility.

Condominium Law (WEG)

In the field of condominium law, we assist owners’ associations, property managers and individual owners with matters including service charges, maintenance and modernisation works, the preparation and conduct of owners’ meetings, and the review and implementation of owners’ resolutions. We also represent our clients in disputes within the owners’ association, both out of court and in court.
